Terms and Conditions

These Terms and Conditions ("Terms") apply to the Kippr mobile application (the "Application") provided by Franciszek Czajka, operating as Lapwing Software ("Service Provider", "we", "us", or "our"). By downloading, accessing, or using the Application, you agree to be bound by these Terms.

Definitions

Application: the Kippr mobile app and related features, content, and services.
User ("you" or "your"): any person who downloads, accesses, or uses the Application.
Subscription: any paid, auto-renewing in-app purchase plan that unlocks premium features.
User Content: information or content you submit, generate, or store through the Application.

License and Intellectual Property

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Application for personal, non-commercial use. You may not copy, modify, reverse engineer, decompile, translate, create derivative works from, or otherwise exploit the Application except as expressly permitted by applicable law.

All trademarks, copyrights, database rights, and other intellectual property rights in the Application are and remain the property of the Service Provider or its licensors.

Accounts and Security

You are responsible for maintaining the confidentiality and security of your device and account credentials, and for activities performed through your account. You must provide accurate information where required and keep it reasonably up to date.

We strongly recommend against jailbreaking or rooting your device, as this may reduce security and prevent proper Application functionality.

Privacy

The Application stores and processes personal data to provide and improve the service. Our handling of personal data is described in our Privacy Policy, which is incorporated into these Terms by reference.

Acceptable Use

You agree not to:

use the Application for unlawful, fraudulent, or abusive purposes;
interfere with or disrupt the security, integrity, or performance of the Application;
attempt unauthorized access to accounts, systems, or data related to the Application;
use automated means to scrape, harvest, or extract data except where expressly allowed by law;
upload or transmit malware, malicious code, or other harmful material.

Third-Party Services and Terms

The Application uses third-party services that are governed by their own terms and policies. Your use of those services is subject to the applicable third-party terms.

Connectivity, Device, and Availability

Some features require an active internet connection. You are responsible for any charges from your mobile network provider, including roaming and data charges. You are also responsible for maintaining a compatible device, sufficient battery charge, and up-to-date operating system support.

We may modify, suspend, or discontinue parts of the Application at any time, including to improve functionality, maintain security, or comply with legal requirements.

Subscriptions and In-App Purchases

The Application offers premium functionality through auto-renewing subscriptions. Billing, payment processing, renewal, cancellation, and refunds are handled by the relevant app store provider (Apple App Store or Google Play Store), not by the Service Provider.

Subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period (or as otherwise stated by your app store).
You can manage or cancel subscriptions in your app store account settings.
Any free trial, if offered, may convert to a paid subscription unless canceled before trial expiry.
Pricing may change in the future; if required, notice will be provided through the store platform or within the Application.
Refund requests must be submitted to the relevant app store under its refund policies.

AI Features, Food Content, and Safety

The Application uses Artificial Intelligence to generate recipes, ingredient suggestions, and related food content. AI-generated outputs are provided for informational and inspirational purposes only and may be incomplete, inaccurate, or unsuitable for your circumstances.

The Application does not provide medical, nutritional, allergy, or food safety advice. You are solely responsible for verifying ingredients, allergens, preparation steps, cooking temperatures, and food safety before consumption.

To the maximum extent permitted by law, we are not liable for adverse reactions, foodborne illness, injuries, or other loss resulting from reliance on AI-generated content.

User Content

You retain ownership of your User Content. You grant us a limited, non-exclusive, worldwide, royalty-free license to host, process, store, reproduce, and display User Content solely as necessary to operate, maintain, secure, and improve the Application.

You represent that you have the rights necessary to submit User Content and that such content does not violate any law or third-party rights.

Warranty Disclaimer

The Application is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Application will be uninterrupted, error-free, secure, or fully compatible with all devices or operating system versions.

Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, goodwill, or business interruption.

Our total aggregate liability arising out of or relating to these Terms or the Application shall not exceed the amount you paid for the Application in the six (6) months immediately preceding the event giving rise to the claim, or the equivalent of USD 0 if you used only free features.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, willful misconduct, or death/personal injury caused by negligence where such exclusion is unlawful.

Suspension and Termination

We may suspend or terminate your access to the Application immediately if you materially breach these Terms, engage in unlawful activity, create security risk, or misuse the Application.

You may stop using the Application at any time. Upon termination, rights granted to you under these Terms end, and you must cease use of the Application.

Governing Law and Dispute Resolution

These Terms are governed by the laws of Poland, excluding conflict of laws principles.

Before filing a formal claim, both parties agree to attempt to resolve the dispute informally for at least 30 days after written notice of the dispute.

If no resolution is reached, disputes may be submitted to the competent courts of Poznan, Poland, unless mandatory consumer protection laws in your country of residence provide otherwise. If you are a consumer, you retain any mandatory rights and remedies available under applicable law.

Changes to These Terms

We may update these Terms from time to time without notifying users in advance. Any updated Terms become effective when posted in the Application or on the website, unless a different effective date is stated.

Your continued use of the Application after the effective date of updated Terms constitutes acceptance of those updated Terms.

Miscellaneous

Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
No Waiver: Failure to enforce any provision is not a waiver of future enforcement.
Assignment: We may assign or transfer our rights and obligations under these Terms where permitted by law.
Entire Agreement: These Terms, together with any referenced policies, form the entire agreement between you and the Service Provider regarding the Application.
